Amends Title 18 re firearms tracing

 

 

PLS Summary:

(PN 1324) Amends Title 18 (Crimes and Offenses) by defining "corrections officer" as a full-time employee assigned to the Department of Corrections whose principal duty is the care, custody and control of inmates of a penal or correctional institution operated by the Department of Corrections. The bill also further defines when and to what degree a corrections officer is justified in using force against an inmate. Also defines "firearm" as any weapon that is designed to or may readily be converted to expel any projectile by the action of an explosive or the frame or receiver of any such weapon. Further provides upon recovering a firearm from the possession of anyone under 21 years of age who is not permitted by Federal or State law to possess a firearm, a local law enforcement agency would use the best available information including a firearms trace where necessary, to determine how and fro where the person gained possession of the firearm. Also provides local law enforcement would use the National Tracing Center of the Federal Bureau of Alcohol, Tobacco and Firearms and would advise the State Police of all firearms that are recovered. Amends Title 34 re use of lights while hunting

 

 

PLS Summary:

(PN 1978) Amends Title 34 (Game) further providing for killing game or wildlife to protect property, for provisions relating to unlawful devices and methods and for exceptions to unlawful use of lights while hunting by adding that a hunter may use a flashlight or spotlight held in the hand, worn on the head or mounted on a firearm to take furbearers, if the sole source of power for light is contained within the light or on the person. Amends Title 30 re fishing licenses

 

 

 

PLS Summary:

(PN 2984) Amends Title 30 (Fish) further providing, in fishing licenses, for nonresident and tourist licenses, for one-day resident fishing licenses, for issuing agents and for license, permit and issuing agent fees. The bill extends the period during which a One-Day Tourist Fishing License and One-Day Resident Fishing License can be issued to March 15 to April 30 (from April 1 to April 30). The timing for issuing agents to remit funds for licenses and permits is changed from monthly to a time frame established by the Commission and agents would be required to secure proof of residency from someone applying for a license. The method of the maintenance of these records would be prescribed by the Commission. Equipment for the issuance of fishing licenses and permits would have to be available at reasonable hours for inspection by any waterways conservation officer or other officer designated by the Commission. Penalties for violations are further provided for in the bill. The cost of a replacement license is increased from $4.25 to $5 and the transaction costs associated with the Pennsylvania Automated Licensing Service (PALS) would be actual cost, not to exceed $1. Amends Title 27 re uniform env. covenants

 

 

PLS Summary:

(PN 2870) Amends Title 27 (Environmental Resources) providing for uniform environmental covenants and stating that an environmental covenant must: (1) state that the instrument is an environmental covenant, (2) contain a legally sufficient description of the real property subject to the environmental covenant, (3) contain a brief narrative description of the contamination and the remedy, (4) describe the activity and use limitations on the real property, (5) identify every holder, (6) be signed, with the formalities required for a deed, and (7) identify the name and location of any administrative record for the environmental response project reflected in the environmental covenant. An environmental covenant would not be required for property owned by the federal government prior to transfer of the property to a non-federal entity or individual. The bill states DEP would establish and maintain a registry containing all environmental covenants and any amendment or termination of those covenants. The registry may also contain any other information concerning environmental covenants and the real property subject to them which it considers appropriate. The registry is a public record for purposes of the Right-to-Know Law. (Prior Printer Number: 68)

Amends Radiation Protection Act

 

 

PLS Summary:

(PN 2086) Amends the Radiation Protection Act further providing for definitions, for powers of Environmental Quality Board, for nuclear facility and transport fees, for creation of special funds, for response program and for transportation of radioactive materials; and making repeals. The Department of Environmental Protection's fee structure review is decreased from every four years to every three years. Additional fees would be charged for those working with high-level waste, transuranic waste or a large quantity of radioactive material. License fees are adjusted or added for several categories associated with nuclear energy and waste production and shipment. $100,000 would be deposited into the Radiological Emergency Response Planning and Preparedness Program Fund and $50,000 would be deposited into the Radiation Emergency Response Fund. Each nuclear power reactor owner would also have to provide the Department existing plant and radiological monitoring data collected from equipment and monitoring methods installed by each owner in accordance with the requirements of its license by the Nuclear Regulatory Commission. By July 1, 2008, each plant owner would have to enter into an agreement with the department establishing the protocols for providing data to the department through an expedited and secure process. The bill also provides for the transportation of radioactive material, stating it would be unlawful for any person to transport upon the highways, waterways or rails any spent nuclear fuel, high-level waste, transuranic waste or a large quantity of radioactive material unless that person notifies the agency in advance. The Environmental Quality Board would, by rule and regulation, set reasonable annual fees for the registration of radiation sources and the licensing of radiation source users. Amends Alt. Energy Portfolio Standards Act

 

 

PLS Summary:

(PN 2343) Amends the Alternative Energy Portfolio Standards Act by phasing in gradually over 15 years the percentage of electric energy required to be sold from Tier I sources that must be from solar photovoltaic and solar thermal technologies. Under this phase-in, the solar photovoltaic share would be 0.50% starting June 1, 2020. The bill states that the alternative compliance payment for the solar photovoltaic share would be 200% of the average market value of solar renewable energy credits sold during the reporting period within the service region of the regional transmission organization, including the levelized up-front rebates received by sellers of solar renewable energy credits in other jurisdictions in the PJM Interconnection. Also, energy derived from alternative energy sources located outside the service territory of a regional transmission organization that manages the transmission system in any part of PA would not be eligible to meet the compliance requirements of this act. The bill provides for alternative energy credits, stating that unless a contractual provision explicitly assigns alternative energy credits in a different manner, the owner of the alternative energy system or a customer-generator owns any and all alternative energy credits associated with or created by the production of electric energy by the facility or customer, and the owner or customer is entitled to sell, transfer or take any other action the owner of property is entitled to take with respect to the credits. The bill further provides for the definitions of "alternative energy sources," "customer-generator," "force majeure," and "net metering." Lastly, the bill states that excess generation from net-metered customer-generators would receive full retail value for all energy produced on an annual basis (Prior Printer Number: 1668, 1995, 2057, 2291, 2297)

Amends Title 66 re electric utilities

 

 

PLS Summary:

(PN 2344) Amends Title 66 (Public Utilities) in restructuring of electric utility industry, further providing for duties of electric distribution companies requiring electric energy to be procured through competitive procurement processes. The electric distribution company or commission- approved alternative supplier may, in its sole discretion, offer large customers with a peak demand of 15 megawatts or greater at one meter at a location in its service territory any negotiated rate for service at all of the customers' locations within the service territory for any duration agreed upon. The bill also adds that for purposes of providing service to customers with a peak demand of 20 megawatts or greater at one meter at a location within that distribution company's service territory, an electric distribution company may acquire an interest in a generation facility or construct a generation facility specifically to meet the energy requirements of the customers including the electric requirements of the customers' other billing locations within its service territory. The bill also requires that the costs associated with the generating facility interests would not be included in rate base or otherwise reflected in rates. Amends act re access to public information

 

 

PLS Summary:

(PN 1763) The Right-To-Know Law reverses the presumption of access to records and puts the burden of proof on a government agency denying access to a record. It provides a list of 29 exceptions for executive agencies and local agencies, which include criminal investigations, Social Security numbers, personal financial information, and individual medical records. Legislative agencies, including the Senate and the House, are required to provide access to 19 categories of records. Judicial agencies are required to provide financial records. The bill also states that the state-related universities are required to provide information from IRS Form 990, along with a list of the highest 25 salaries for university employees. It also creates an online, searchable database of state contracts. The legislation creates an independent Office of Open Records, housed in DCED, with an executive director appointed by the governor to a six-year term. The Office would establish standard fees for photocopying records, and create a uniform form that can be used to request records. The bill makes changes to the process of obtaining public records in Pennsylvania and changes the appeals process. The legislation reduces the time period for response by a Commonwealth agency and legislative agency from 10 days to 5 days. The bill clarifies that academic transcripts and tests, and the name, address and birth date of children 17 and under are not open records. Also, the bill increases financial penalties for noncompliance and allows plaintiffs to recover attorneys' fees if an agency acts in bad faith. The section on the Office of Open Records is effective immediately, while the rest of the bill applies to requests for information made after December 31, 2008. Act re Hazardous Sites Cleanup Fund re funding

 

 

PLS Summary:

(PN 1617) The Hazardous Sites Cleanup Fund Funding Act states the Majority Leaders and the Minority Leaders of the House and Senate would direct the Chief Clerk (in the Senate) or Comptroller (in the House) to prepare and present to the State Treasurer the necessary documentation which lapses into the General Fund for the fiscal year 2007-2008 from prior fiscal years' appropriations to the House and Senate the sum of $2,500,000 from accounts under the control of each leader. A sum of money equal to the amount lapsed would be transferred to the Hazardous Sites Cleanup Fund within 30 days. The required annual report required by the Hazardous Sites Cleanup Act would be transmitted by the department to the General Assembly each year and would be published on the department's website. The report must also include the number and a description of the emergency responses initiated by the department and the costs incurred in the aggregate and for each emergency response, the number and nature of violations of the Hazardous Sites Cleanup Act and the amount of fines and penalties assessed, in the aggregate and for each violation, and the amount expended for personnel costs. The Department of Auditor General would annually conduct an audit of the fund and submit a copy of the audit to the chairman and the minority chairman of the Environmental Resources and Energy Committee of the House and Senate. $8,000,000 is appropriated from the General Fund to the Hazardous Sites Cleanup Fund.
