Amends Title 34 re buying & selling game

 

 

PLS Summary:

(PN 93) Amends Title 34 (Game) defining "mounted specimen" as any game or wildlife, or any portion or part thereof, prepared, preserved, arranged, set up or posed in a life-like position or some other form of display. The bill also provides for buying and selling game by stating that the section would not be construed to prevent: (1) the purchase or sale of game raised under the authority of a propagating permit in PA, (2) the capture and sale of game or wildlife after securing a permit from the director and payment of any fees, (3) the sale of the tanned, cured or mounted heads or skins, or parts thereof, of any game or wildlife not killed in a wild in PA, (4) the sale or purchase of any inedible part from game or wildlife lawfully killed, if the parts are disposed of by the original owner within 90 days after the close of the season, and (5) the sale of mounted specimens by any licensed auctioneer.

(PN 181) The Hunting Heritage Protection Act would require Department managed lands to be open to access and use for recreational hunting. The Department of Conservation and Natural Resources would not be required to give hunting a priority over other uses of the land, but the Department must ensure that their actions, to the greatest practical extent, do not result in a net loss of acreage for hunting. The Secretary would be required to report to the General Assembly by October 1 of each year on the acreage administered by the Department that has been closed during the previous year to recreational hunting and the reasons for the closures and the acreage administered by the Department that was opened to recreational hunting to compensate for acreage closed.

(PN 620) Amends Title 34 (Game) by stating that nothing in this title would be construed to prohibit any person from killing any game or wildlife: (1) which the person may witness actually engaged in the material destruction of an agricultural commodity, (2) anywhere on the property under the person's control immediately following such destruction; or (3) where the presence of the game or wildlife on any lands upon which there exists an agricultural commodity is just cause for reasonable apprehension of additional imminent destruction. The bill also provides for deer control permits by stating that the director would issue a permit to control deer within 30 days of receipt of an application by a local government unit or by any department, agency, board or commission of a government unit or by a common interest community.

Advisory committees would be required to provide public notice of all of the committee meetings and each meeting would be open to the public. The members of an advisory committee would be posted on the commission's Internet website.

PLS Summary:

(PN 963) Amends Title 34 (Game) further providing for use of Game Fund revenues. Under the allocation of revenue provisions, the bill calls for a minimum of 10% of the previous fiscal year's revenues from timber harvesting to be used solely for the purpose of forest regeneration activities. A reforestation practice entered into as part of a timber harvesting contract by the commission shall be included for purposes of calculating revenues from timber harvesting. The money collected will be deposited into a separate account and used exclusively for production, distribution and planting of trees and spraying and deer fencing on commission land. The account will operate as a revolving fund.

(PN 1978) Amends Title 34 (Game) further providing for killing game or wildlife to protect property, for provisions relating to unlawful devices and methods and for exceptions to unlawful use of lights while hunting by adding that a hunter may use a flashlight or spotlight held in the hand, worn on the head or mounted on a firearm to take furbearers, if the sole source of power for light is contained within the light or on the person.
