(PN 1884) Amends the PA Farmland and Forest Land Assessment Act by adding that the owner of property subject to preferential assessment may lease land covered by the preferential assessment to be used for a wind power generation system when certain conditions are satisfied. The bill further provides that roll-back taxes imposed on the tract of land would be adjusted accordingly and the lease of a tract of land would not invalidate the preferential assessment of the land which is not leased. The wind power generation system provider would be solely responsible for obtaining required permits in connection with any construction on a tract of land which it leases. Amends PA Farmland & Forest Land Act re lands

 

 

PLS Summary:

(PN 779) Amends the PA Farmland & Forest Land Assessment Act further providing for definitions, for land devoted to agricultural use, agricultural reserve, and/or forest reserve, for applications for preferential assessments, for responsibilities of the county assessor in general, for civil penalties, for roll-back taxes, special circumstances and for appeals. Land presently devoted to agricultural reserve or forest reserve is increased from 10 to 30 contiguous acres for general property tax purposes. Applications for preferential assessments are provided as are the duties for the Department as it relates to preferential assessments and County Assessors. The penalty that can be imposed by the county board for assessment appeals is increased from $100 to $300 unless a determination is made that a landowner who received a preferential assessment submitted false information for the purpose of qualifying for preferential assessment or continuing to qualify for preferential assessment in which case the county board of assessment would assess a civil penalty of $1,000.

(PN 406) Amends the Dog Law by adding that people using service dogs may apply for a lifetime license for a dog. Service dogs would be exempt from wearing a license tag. No fee would be charged for the license. The license for a service dog may be passed on to a successive service dog after the death or other replacement of the previous licensed dog.

Currently the secretary may revoke or suspend kennel licenses for those offenses and may seize the dogs. Additionally, the bill states the secretary may revoke or suspend a license or refuse to issue a kennel license or out-of-state dealer license if the person holding or applying for a license has failed to comply with any regulation promulgated under this act other than those for the humane handling, transportation, veterinary care, housing, breeding, socialization, feeding, watering or other humane treatment of animals.

The bill also provides for upkeep of animals by stating that an owner would be responsible for paying the costs of keeping and caring for any animal held by a humane society or association for the prevention of cruelty to animals if the animal is being held in connection with a charge filed under this section. An owner would be deemed to have abandoned an animal if the owner fails to make full payment of reasonable costs of transportation, feeding, care and veterinary expenses within 20 days of a second written request by a humane society or association for the prevention of cruelty to animals that is holding the animal.

(PN 1307) Amends the Dog Law further providing for registration of dangerous dogs by adding that during court proceedings, a dog must be on a substantial chain and under physical restraint of a responsible person. A muzzle must not interfere with the dog's breathing or vision, but must prevent the dog from biting or damaging property. A violation would be subject to an $800 (increased from $200) fine. The legislation provides for grading of violations, depending on whether it is a first offense, or if a person or property is attacked.

Amends Local Option Small Games Act re games

 

 

PLS Summary:

(PN 2631) Amends the Local Option Small Games of Chance Act by stating that daily drawing chances may not be sold for an amount in excess of $1, and no more than one chance per individual may be sold per drawing. The bill would not restrict an eligible organization from conducting more than one drawing per day. The bill also removes the requirement that an eligible organization may not conduct daily drawings during a period when a weekly drawing is taking place or vice versa. An eligible organization may conduct a raffle and award a prize or prizes valued in excess of $1,000 each only if the licensing authority has issued a special permit for the raffle. Eligible organizations would be eligible to receive no more than three special permits in any licensed year. The bill defines the term "monthly drawing" and states that monthly drawing chances may not be sold for an amount in excess of $1. The bill further provides for prize limits and for certain exceptions to the prize limits. Also provides for insured games. Requires eligible organizations to report to the Department of Revenue prizes awarded as required by section 335 of the Tax Reform Code. Also allows more than one organization to use the same location, provided each organization has its own license and that the prize limitations of act would apply separately to each organization.
